Terms of Service

These Terms of Service ("Terms") govern your use of Hynah — the agentic IDE, AI operating system, desktop applications, and related services (together, the "Service") provided by Hynah ("we", "us"). By downloading, installing, or using the Service you agree to these Terms.

1. Your account

• You must provide accurate registration information and keep your credentials confidential.
• You are responsible for activity that occurs under your account.
• You must be at least 16 years old to use the Service.

2. License and acceptable use

We grant you a personal, non-exclusive, non-transferable license to install and use the Hynah desktop application for software development, subject to these Terms. You agree not to:

• Reverse engineer the Service except where permitted by law.
• Use the Service to violate any law, infringe intellectual property, or distribute malware.
• Probe, scan, or test the vulnerability of our systems without written permission (see our Security page for responsible disclosure).
• Resell, sublicense, or provide the Service to third parties as a hosted offering.
• Circumvent usage limits, licensing, or access controls.

3. Your content and code

• You own your code. We claim no intellectual property rights over your repositories, files, prompts, or agent outputs created in your workspace.
• Code generated or modified by AI agents in your workspace is yours to use, review, and ship. You are responsible for reviewing agent output before merging or deploying it.
• You grant us only the limited rights needed to operate features you enable (for example, end-to-end sync of a workspace you create).

4. AI features and third-party models

• Hynah is model-agnostic. When you select a third-party model provider, your use of that provider is also governed by the provider's own terms.
• Where you supply your own API keys, you are responsible for your usage and costs with that provider.
• AI output can be wrong, incomplete, or insecure. The Service does not replace code review, testing, or professional judgment.

5. Plans and payment

• The individual plan is free as described on the download page; paid plans are billed in advance and renew automatically until cancelled.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.
• We may change prices with at least 30 days' notice.

6. Updates and changes

The desktop app may auto-update to keep your installation secure and compatible. We may add, change, or remove features; if a change materially reduces functionality you paid for, you may cancel for a pro-rated refund of the remaining term.

7. Warranty disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be correct.

8. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
• Our aggregate liability arising out of these Terms is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid nothing.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

10. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate access for breach of these Terms, with notice where practicable.
• Sections that by their nature should survive (ownership, disclaimers, liability limits, indemnification) survive termination.

11. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Disputes will be resolved in the courts of competent jurisdiction, unless mandatory local law provides otherwise.

12. Changes to these Terms

We may update these Terms from time to time. We will post changes here, update the date above, and give advance in-app notice of material changes. Continued use after changes take effect constitutes acceptance.
